Those pesky Total Maximum Daily Loads
of the Clean Water Act

The
Federal Water Pollution Control Act; 1972 as amended, also known as the Clean
Water Act (CWA) passed by Congress by an override of Richard Nixon’s veto is
administered by the Environmental Protection Agency (EPA). The origin of the Act dates to 1948 with many
amendments most notably with the 1972 rewrite, additional amendments continued
to occur with the last in 2014. The
law called for "zero discharge of pollutants into navigable waters by
1985, and fishable and swimmable waters by 1983." The Act starts with
Title I: Research and Related
Programs, Section 101; Declaration
of Goals and Policy and ends with Title
VI: State Water Pollution Control Revolving Funds, Section 608: Requirements.
In
between the first and last sections of the Act is a lot-of-language and this
writing is about Section 303(d). The Clean Water Act was advocated and passed with the
following goal: “to restore
and maintain the chemical, physical, and biological integrity of the nation's
waters by preventing point and nonpoint pollution”. The CWA preamble declares that: “Our nation’s waters should be swimmable and fishable”. Water discharges at point source
locations by industry are authorized by the EPA but normally administered by
state through the National Pollution Discharge Elimination System (NPDES) a
requirement of the CWA within Section 402.
Title III: Standards and Enforcement, Section 303: Water Quality Standards
and Implementation Plans, Clause (d): Each state shall identify those
waters within its boundaries for which the effluent limitations required by
Section 301(b)(1)(A) and Section 301(b)(1)(B) are not stringent enough to
implement any water quality standard applicable to such waters. The State shall
establish a priority ranking for such waters, taking into account the severity
of the pollution and the uses to be made of such waters.
Waters
of the state should reflect aquatic wellbeing and their pristine valuable
qualities. Tennessee considers the use of “Essential Waters” to be for
industry, livestock, irrigation, domestic water supply, fish and aquatic life,
wildlife and recreation. If any of the uses of essential waters are impacted
above Total Maximum
Daily Load (TMDL) identified levels then the waters are impaired.
To
fully understand Section 303(d) it is necessary to understand (TMDL). All surface waters flow from a high location
to a low or “from the mountains to the sea”. As surface waters flow they pick
up geologic particles, surface soils and other materials. If the surface is
impacted by our activities with materials that pollute this pollution too is picked
up by the water. It is these materials both natural and introduced that are considered
the load. Measuring the material within
any specific volume of water is the total
load. It is important to understand the total load in perspective of each day
so the measurement of this is Total Daily
Load. The EPA has determined that there are a number of chemicals,
bacterium’s and physical materials that constitute pollution or unhealthy
aquatic systems and so the EPA has determined each of these for a maximum
amount allowable to have the Total Maximum
Daily Load or TMDL.
Focusing
on the Nolichucky River specifically is the concern of this article and the
writings that follow. The Tennessee portion of the Nolichucky River
Watershed is located in East Tennessee and includes parts of Cocke,
Greene, Hamblen, Hawkins, Jefferson, Unicoi and Washington counties. The
Nolichucky River watershed drains portions of North Carolina and eastern
Tennessee. The
Nolichucky watershed is 1762 square miles (64% in TN and 36% in N.C.), the 303 (d)
or TMDL of the Nolichucky and its tributaries are heavily impaired. The
waters of Tennessee according to the “Izaak Walton League” are in serious need
of improvement and the League has documented a score for the state’s success in
administering water health:
“Transparency C, Site-Specific Information F, Age of Data B, Frequency
of Sampling B, Water Quality Standards C, Volunteer Engagement F; final grade 50%.
Some
of the materials that constitute TMDL are E. coli pathogens, Nitrates,
Nitrites, Phosphorus, Sedimentation, Siltation and some metals. The EPA list is
lengthy but not all pollutants are listed for TMDL. Water pollutants are from
agriculture, mining, forestry, development, roads, municipal wastewater
discharge and many other sources. Many of the discharge sources “point and
nonpoint” are regulated but some such as with polluted storm water runoff is commonly transported through
municipal separate storm sewer systems (MS4s), and then often discharged,
untreated, into local water bodies.

Many
species of aquatic and terrestrial life have been impacted by our introduction
of pollutants and stream alteration. Native brook trout have been adversely
affected by the decreasing water quality in the creeks of the southeastern
states. Higher water temperatures due to the denuding of streamside vegetation
by logging, farming or development cause decline of brook trout numbers due to the
resultant silting and negative water purity. This water quality change forced the
species to retreat from it traditional home waters and find the only acceptable
habitat in the higher elevations and those streams no longer being impacted due
to development practices. Additionally; more than 30 species of fresh water
mussels are native to the Nolichucky however some have become extinct, some are
listed as endangered or threatened and many are in decline resulting due to
sedimentation, change in water depth, pollutants and more. Other species as with the river cooter are in
decline heavily due to water impoundments, snapping turtle and many native fish
species are also impacted negatively due to water quality and over harvest. Our
regulations often focus attention on federally or state listed species of
concern but the more common species receive less attention and this lack of
concern potentially leads to decline, injury and future listing. The Tennessee Department of Environment and
Conservation (TDEC) draft report of 2016 for impaired waters of the Nolichucky
watershed lists more than 660 miles of streams impaired and that is only in
Tennessee, 36% of the watershed is in North Carolina.
Major land uses in the Nolichucky River
watershed are forest (61.2 percent), pasture/farm (28.1 percent) with the
remainder in other uses. High levels of E. coli and sediment in the Nolichucky River
prompted TDEC to add segments of the Nolichucky River to their list of impaired
waters. A lower segment of the river is 7.7 miles long and extends from Flat
Creek to Bent Creek in Cocke and Hamblen counties is listed due to the impaired
waters for E. coli from pasture grazing. Another segment is 9.4 miles long and
extends from Little Chucky Creek to Evans Island in Greene County. TDEC added
this segment to the list as impaired for biological integrity from siltation. A
third segment is 6.6 miles long and extends from Evans Island to Pigeon Creek
in Greene and Cocke counties. TDEC added this segment to the impaired waters
list for E. coli and biological integrity from siltation. Bacteria levels in
all three segments exceeded Tennessee’s water quality standard for E. coli,
which requires that no individual sample exceed 941 colony-forming units (cfu)
per 100 milliliters (mL) or 126 cfu/100 mL. Pollution from agricultural lands
has led to high levels of Escherichia coli and sedimentation. In addition to the
main stem of the river other tributaries as with Lick Creek, Big Limestone
Creek and Little Limestone Creek and many others are listed for above TMDL
allowable levels and are impaired.
With our heavy and continued use of
land and the multitude of run off and discharge of pollutants to our state and
national waters, the most “regulated” of these pollutions are “point source
discharges” as required by Section 402 of the CWA and the authorization of
NPDES permits. This authorization is a complicated process maintaining that
dilution of pollution discharges not exceeding TMDL levels is acceptable.
However if the river is compromised by pollutions other than TMDL’s by chemicals
this adds injury to the water and to aquatic life. A case in point is the
recently authorized NPDES permit for U.S. Nitrogen LLC. An explosive factory
near Greeneville that processes Nitric Acid, Ammonium and Aqueous Ammonium
Nitrate, the processing and cooling waters for this operation is withdrawn from
the Nolichucky and later discharged in return to the river with wastes
including high amounts of Nitrates and Nitrites. U.S. Nitrogen’s original point
source discharge request was Lick Creek but its impairment of these
nitrogen-based chemicals prevented a NPDES discharge authorization. This
necessitated U.S. Nitrogen to select another location for it discharge, hence
the Nolichucky. In Tennessee if water is polluted (Lick Creek) it cannot be polluted
further but if it is unpolluted for a specific TMDL than it can be polluted
(Nolichucky River).
The impaired waters of Tennessee with
heavy TMDL levels cause the waters to be un-supporting the intended use of the
waters of the Nolichucky and its tributaries and has lead to the impact of
critical habitat for the Oyster mussel, Cumberlandian combshell mussel the
snail darter, state threatened blue sucker and others. Additionally Davy
Crockett Lake valued for its waterfowl sanctuary habitat is also impaired. The Middle Nolichucky Watershed Alliance currently
says that 58 of 85 named streams within Greene County, where U.S. Nitrogen is
located, alone are listed on the EPA's impaired stream list. This means that
more than half of the streams in Greene County are in critical need of protection.
At
first glance the Nolichucky River appears to be swimmable and fishable but
taking in a mouthful of its impaired waters may be a risk. The vast number of contaminants not recorded
for TMDL requirement and introduced by our agricultural, yard chemicals and
materials, highways, development sites and more could be a serious concern for a
swimmer in the Nolichucky. As for those pesky radioactive materials that may
have escaped Nuclear Fuels Services at Erwin or Aerojet Rocketdyne at
Jonesborough just may give you cancer some time in the future. As for fishable,
yes there are fish and they can be caught but the fisheries isn’t healthy and
the aquatic system has been and is being injured by our activities, authorized
and unauthorized. Mussels are in decline due the habitat change and degradation
and the fish required by freshwater mussel larval (glochidia) stages for a host are also in poor aquatic condition.
The goal of the CWA is “to restore and maintain the chemical,
physical, and biological integrity of the nation's waters by preventing point
and nonpoint pollution” and further: “Our nation’s waters
should be swimmable and fishable”. In addition to the CWA there is also the state law; Tennessee
Water Quality Control Act, its goal: … ”the
waters of the state are held in public trust for the use of the people of the
state” … “is to abate existing
pollution of the waters of Tennessee, to reclaim polluted waters, to prevent
the future pollution of the waters”.
If
these waters above described are impaired and beyond TMDL levels as required by
Section 303(d) of the CWA and also have many other chemicals that are in
diluted form should not the EPA and TDEC be required to fulfill their legal
obligation and the goal of their water quality laws? Without a desire to have
the healthiest of waters and with our legislative and executive officers working
diligently to compromise the law for shortsighted gains is that not an
abdication of our right to a healthy environment, a human environment, a “Civil Right”. I argue this is a Civil Right
of our citizens and that we demand a deep respect for the natural world and we should
expect our government officials to understand the importance of the natural
world and it’s relation to a healthy populace as well as a healthy ecosystem.
The following are two summary
sheets of impaired waters of the Nolichucky. First a list from 2006, which is
an easy review and second a list from the 2016 draft report that is more
specific.
